By booking a collection, accepting a quotation, or allowing our team to carry out work at your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings given:
Customer means the person, company, or organisation requesting the services of Rubbish Clearance Surrey.
Services means any rubbish clearance, waste removal, waste collection, loading, transport, or associated work carried out by Rubbish Clearance Surrey.
Waste means any items, materials, goods, furniture, appliances, green waste, construction waste, or other refuse to be removed by Rubbish Clearance Surrey in the course of providing the Services.
Premises means the property, site, or location at which the Services are to be provided.
Rubbish Clearance Surrey provides rubbish clearance and waste collection services within its designated service area. The Services typically include the loading, removal, and lawful disposal or recycling of Waste from domestic and commercial Premises.
The details of the Services, including the type and approximate quantity of Waste to be removed, the access arrangements, and any special requirements, will be agreed at the time of booking or quotation. Rubbish Clearance Surrey reserves the right to refuse to remove any items that are hazardous, prohibited, unsafe to handle, or outside the agreed scope.
Bookings may be made by telephone, email, or through any booking system operated by Rubbish Clearance Surrey. When making a booking, the Customer must provide accurate information about the type, volume, and location of the Waste, any access restrictions, and any relevant parking or timing requirements.
Any quotation provided by Rubbish Clearance Surrey, whether verbally or in writing, is based on the information supplied by the Customer. Quotations are estimates and may be subject to change if the actual volume or nature of the Waste, or the access conditions, differ from what was described at the time of booking.
Rubbish Clearance Surrey will confirm the booking details such as date, approximate arrival time window, and anticipated cost. A booking is not considered confirmed until accepted by Rubbish Clearance Surrey.
The Customer is responsible for ensuring suitable access to the Premises for the vehicle and team carrying out the waste collection. This includes providing any necessary codes, keys, or permissions to enter shared or restricted areas.
The Customer must ensure that adequate parking is available as close as reasonably possible to the Premises. Any parking fees, permits, or penalties incurred as a direct result of providing the Services may be added to the final invoice where these were unavoidable and not due to any fault of Rubbish Clearance Surrey.
If access or parking issues prevent or significantly delay the performance of the Services, Rubbish Clearance Surrey may cancel or rearrange the booking and may charge a call-out or wasted journey fee.
The Customer must ensure that:
The Waste to be removed is clearly identified and accessible to the team on the agreed date and time.
There are no hidden or hazardous materials within the Waste, such as needles, asbestos, chemicals, or other dangerous substances, unless expressly agreed in advance in writing.
Children, pets, and other persons are kept away from working areas for the duration of the collection to maintain health and safety standards.
The Customer or an authorised representative is present at the Premises during the collection unless otherwise agreed.
The Customer warrants that they are the owner of the Waste or have full authority from the legal owner to arrange its removal and disposal.
Prices for the Services are generally based on the volume, weight, and type of Waste, the labour involved, and any specific access or handling requirements. Any indicative prices provided online or by telephone are for guidance only and do not constitute a binding quotation.
Where possible, Rubbish Clearance Surrey will confirm a final price on arrival after assessing the Waste and access conditions. If the Customer does not agree to the revised price, Rubbish Clearance Surrey reserves the right not to proceed with the collection and may charge a reasonable call-out or assessment fee.
All prices are quoted exclusive of any applicable taxes unless expressly stated otherwise. Any taxes, duties, or levies imposed by law will be added to the final invoice where applicable.
Payment is due in full on completion of the Services unless otherwise agreed in writing prior to the booking. Payment may be made by cash, card, bank transfer, or any other method accepted by Rubbish Clearance Surrey at the time of service.
For commercial Customers, credit terms may be offered at the sole discretion of Rubbish Clearance Surrey. Any credit invoices must be paid within the agreed payment term. Failure to pay on time may result in interest and charges being applied in accordance with applicable UK legislation.
Rubbish Clearance Surrey reserves the right to withhold or suspend further Services to any Customer whose account is overdue.
The Customer may cancel or amend a booking by providing notice to Rubbish Clearance Surrey. Where possible, the Customer should provide at least 24 hours notice for cancellations or significant changes to the booking details.
Rubbish Clearance Surrey reserves the right to charge a cancellation fee where late notice is given or where a wasted journey occurs due to circumstances within the Customer's control, including but not limited to:
Failure to provide access to the Premises.
Failure to have the Waste ready for collection.
Refusal to proceed at the agreed or revised price.
In the rare event that Rubbish Clearance Surrey must cancel or reschedule a booking, it will make reasonable efforts to notify the Customer as soon as practicable and to arrange an alternative date and time. Rubbish Clearance Surrey will not be liable for any loss or inconvenience caused by such re-scheduling, save as required by law.
Rubbish Clearance Surrey operates in accordance with applicable UK waste management regulations and environmental legislation. The company holds, or uses carriers holding, appropriate waste carrier authorisations where required by law and aims to maximise recycling and responsible disposal.
By engaging the Services, the Customer acknowledges their duty of care under relevant waste legislation to ensure that Waste is transferred only to an authorised person. Rubbish Clearance Surrey will provide appropriate waste transfer documentation where required, and the Customer should retain such documentation for their records.
Certain items may not be collected or may incur additional charges, including but not limited to hazardous waste, clinical waste, asbestos, chemicals, gas bottles, tyres, or electrical items requiring special handling. It is the Customer's responsibility to declare such items in advance. Rubbish Clearance Surrey may refuse to collect any Waste that it reasonably believes to be hazardous or non-compliant with waste regulations.
Once the Waste has been loaded onto Rubbish Clearance Surrey's vehicle, title and risk in the Waste shall pass to Rubbish Clearance Surrey, subject to the Waste being as described by the Customer and not consisting of prohibited or undisclosed hazardous materials.
If any Waste collected is later found to include prohibited or hazardous materials that were not declared, the Customer may be held responsible for any resulting costs, penalties, or liabilities incurred by Rubbish Clearance Surrey in dealing with such Waste.
Rubbish Clearance Surrey will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that minor scuffs or marks may occur during the movement of bulky items, particularly in tight spaces. The Customer is responsible for protecting floors, walls, and fixtures where necessary.
Rubbish Clearance Surrey will not be liable for:
Any pre-existing damage to property, fixtures, or fittings.
Minor cosmetic damage arising from the normal course of moving large or heavy items, provided reasonable care has been taken.
Any loss or damage resulting from inaccurate or incomplete information supplied by the Customer.
Any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
Subject to the above, the total liability of Rubbish Clearance Surrey for any claim arising out of or in connection with the Services shall not exceed the total price paid or payable by the Customer for the specific job giving rise to the claim.
If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Clearance Surrey as soon as possible, providing details of the issue and any supporting information. Rubbish Clearance Surrey will investigate the complaint and will aim to respond within a reasonable period.
Where a complaint is upheld, Rubbish Clearance Surrey may, at its discretion, offer a remedy such as a partial refund, a price adjustment, or a repeat service. Any such remedy will be in full and final settlement of the complaint.
Rubbish Clearance Surrey shall not be liable for any delay or failure to perform the Services where such delay or failure is due to circumstances beyond its reasonable control. These circumstances may include, but are not limited to, extreme weather, traffic incidents, road closures, accidents, illness, industrial disputes, acts of government or public authorities, or disruption to utilities.
In such cases, Rubbish Clearance Surrey will make reasonable efforts to rearrange the booking at a mutually convenient time once the circumstances have been resolved.
Rubbish Clearance Surrey may collect and process personal information relating to Customers in order to manage enquiries, bookings, payments, and service delivery. Personal data will be handled in accordance with applicable UK data protection law.
Customer information will not be sold to third parties. It may, however, be shared with trusted service providers where necessary to carry out the Services or to comply with legal obligations.
Rubbish Clearance Surrey reserves the right to amend these Terms and Conditions from time to time. Any updated terms will apply to future bookings and will be made available upon request or published through usual communication channels.
The version of the Terms and Conditions in force at the time of booking will apply to that booking, unless a change is required by law or by a regulatory authority.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Clearance Surrey.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed deleted, but such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.
These Terms and Conditions, together with any written quotation or booking confirmation issued by Rubbish Clearance Surrey, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings or agreements, whether written or oral.
No variation of these Terms and Conditions shall be effective unless agreed in writing by an authorised representative of Rubbish Clearance Surrey.
